Your 485 is a clock, not a pathway

Your 485 is a clock, not a pathway. AuzRoo Immigration Consultants.

Graduation day feels like the finish line. The course is done, the visa comes through, and for the first time in years nobody is asking you for an assignment. You find a job, you pay rent, life gets busy.

Then the second year starts and the questions change. Is my occupation still on the list. Do I have enough points. Why does none of my work experience count.

Every year we meet two people who graduated from the same course, on the same day, with the same visa. One has a skills assessment done and a nomination in progress. The other has eight months left and nothing to show for it. The difference is almost never ability. It is what they did in the first six months.

Nobody sits you down and explains that part. So here it is.

The Temporary Graduate visa, subclass 485, does not lead to permanent residence. It gives you a window. What matters is what you build inside it.

How long your window actually is

There are two streams. Which one you get depends on what you studied, not on what you want.

The Post-Higher Education Work stream is for degree graduates.

Your qualification How long you can stay
Bachelor degree, including honours 2 years
Masters by coursework, or extended Masters 2 years
Masters by research 3 years
Doctoral degree 3 years
Graduate Diploma 2 years, sometimes longer

The Post-Vocational Education Work stream is for an associate degree, diploma or trade qualification. It gives you up to 18 months.

If you hold an Indian passport

Under the Australia India Economic Cooperation and Trade Agreement you are given more time.

Your qualification How long you can stay
Bachelor degree, including honours 2 years
Bachelor with first class honours in STEM, including ICT 3 years
Masters by coursework, extended Masters, or Masters by research 3 years
Doctoral degree, PhD 4 years

A first class honours result in a STEM degree is worth a full extra year. A PhD is worth four years instead of three. That is worth knowing before you choose a course, not after you finish one.

Hong Kong and British National Overseas passport holders may be granted up to five years.

Three rules that end the conversation early

  • You must be 35 or under when you apply. The exceptions are narrow.
  • You must be in Australia when you apply, and you must have held a student visa in the last six months.
  • The visa cannot be extended. Not once, not for any reason.

Miss that six month window and there is no appeal to make. The visa is simply not available to you any more.

What usually goes wrong

1. Taking any job that pays

Two years in retail or hospitality builds an income, not a case. Points and state nomination both look at skilled work in your nominated occupation. Unrelated work counts for very little, no matter how hard you worked.

2. Leaving the skills assessment until the end

Assessing authorities take weeks, sometimes months. Some want documents from your home country, which adds more time again. If the result comes back negative you need room to respond. Starting this in your final year is starting too late.

3. Sitting on the minimum English score

Competent English gets you over the line for the visa. It earns you zero points. The points sit at Proficient and Superior. People lose a nomination by ten points they could have earned with one more test sitting.

4. Assuming your occupation is safe

Occupation lists change. The occupation that suited your course two years ago may not suit the visa you are aiming at now. Check it against the current list for that specific visa, not the one a friend told you about.

5. Moving state for a job

Most state and territory nominations want you living and working in that state, often for a set period before you apply. Moving in month eighteen can reset the clock you were relying on.

6. On the vocational stream, missing the skills assessment requirement

For the Post-Vocational Education Work stream your qualification must relate to an occupation on the skilled occupation list, and you must have already applied for a skills assessment when you lodge. Not later. When you lodge.

How to plan it

Work backwards from the expiry date, not forwards from today.

When What to do
Month 1 to 3 Confirm your occupation and the assessing authority. Order transcripts and references. Book the English test. Lodge the skills assessment.
Month 4 to 12 Work in your nominated occupation. Keep payslips, contracts and position descriptions. Sit English again to lift your score.
Month 12 to 18 Calculate your points honestly. Read the nomination criteria for the state you are aiming at. Decide between a state route, a regional route or an employer.
Final 6 months Lodge the expression of interest, or the second 485 if you studied regional. Not in the last month.

If you are on an 18 month vocational visa, halve every one of those.

Four questions to answer in your first month

  1. What occupation am I claiming.
  2. Who assesses it, and what do they want from me.
  3. What score do I need, and what is my score today. The points calculator takes five minutes.
  4. Which route fits the life I actually want. Independent, state nominated, regional, or employer sponsored.

If you cannot answer all four, that is your work for the month.

If you studied in a regional area

There is a second visa. The Second Post-Higher Education Work stream gives you between one and two more years, depending on where you studied and where you have been living.

To qualify you need a degree from an institution in an eligible designated regional area, the same study that led to your first 485, and you must have lived in an eligible regional area for at least two years.

That is a real extension of your window. It is also a decision you make at enrolment, three or four years before it pays off.

The point of all this

The 485 is generous. Two to four years is a long time to finish a skills assessment, lift an English score and build relevant work history.

It is also no time at all if you start in month twenty.

Every figure above comes from the Department of Home Affairs subclass 485 pages, current at the date of this article. Rules change, and occupation lists change more often than the visa does. Check your own situation against the current requirements before you act on any of it.

If you are on a 485 now, or you will be soon, the useful question is not what the visa lets you do. It is what needs to be in place before it expires. Book a consultation and we will map that out against your dates.
